Effective date: 20 October 2026 · Last reviewed: 20 October 2026
These Terms of Service set out the rules that apply when you use this website or contact the resident services desk of RDF UTAH CONDOS LLC. The operating company is RDF UTAH CONDOS LLC, 2001 Wilshire Blvd Ste 650, Santa Monica - 90403-5864, United States (US). These terms do not replace a signed lease. Where a lease or a building rule says something different about a tenancy, the lease and the building rule take priority for that tenancy, and these terms continue to govern the website and the general conduct of the desk.
1. Acceptance of These Terms
By visiting this website, sending a message through the contact page, telephoning the desk or visiting the office at 2001 Wilshire Blvd Ste 650, Santa Monica - 90403-5864, United States (US), you agree to these Terms of Service. If you do not agree, please do not use the website or the services described on it.
If you contact us on behalf of a household, a company or another person, you confirm that you are authorized to do so and that the household or organization agrees to these terms. Where an applicant is under eighteen years of age, a parent or legal guardian must act on that person behalf.
These terms apply together with any signed lease, any building rules provided at move-in and any separate document that we ask you to sign for a specific service. Where those documents conflict with these terms, the signed document controls for the subject it covers.
2. Definitions
In these terms, the words we, us and our refer to RDF UTAH CONDOS LLC. The words you and your refer to the person using the website or the services. The term website means the pages published at rdfutahliving.buzz. The term desk means the resident services desk operated by the company from Santa Monica. The term lease means the signed rental agreement for an apartment, including its addenda. The term apartment means a condominium home leased from our portfolio. The term building rules means the rules adopted by the condominium association or the property management team for a building.
A reference to writing includes email and a message sent through the contact page, unless a specific clause requires a signature or a posted notice. A reference to a working day means Monday to Friday, excluding public holidays in California.
3. Use of the Website
The website provides general information about our leasing services, our location and the way to contact the desk. It is intended for personal, non-commercial use by people who are genuinely interested in leasing an apartment, in a current tenancy or in a community matter connected to one of our buildings.
You may print or save a copy of a page for your own reference. You may share a link to a page with another person who may be interested in our services. You may not copy substantial parts of the site into another publication, present our content as your own or use automated tools to harvest contact details, availability information or other content for a competing service.
We aim to keep the site available and accurate, but we do not promise uninterrupted access. Maintenance, security work or a hosting failure may make the site temporarily unavailable. Information on the site is provided for general guidance and does not create a binding offer of an apartment.
You are responsible for the device and connection you use. You should keep your browser and operating system up to date and avoid sending sensitive documents through channels that are not appropriate for them.
4. Availability Information
Availability changes frequently. A unit that is listed on the site or described by email may be withdrawn, rented or altered before you complete an application. We try to update the availability file promptly, but the listing is an invitation to enquire, not a binding offer capable of acceptance.
Details such as rent, deposit, square footage, parking position and earliest move-in date are provided in good faith based on the information held by the desk at the time. Where a figure changes, we will tell you before you sign a lease. Photographs are intended to give a fair impression of the apartment and are not a guarantee of the condition of furniture, décor or appliances unless the lease states otherwise.
If you make travel arrangements to view an apartment, please confirm the appointment with the desk first. We are not responsible for travel costs incurred for a viewing that has not been confirmed in writing.
5. Applications and Leasing
An application must be completed truthfully and in full. You are responsible for the accuracy of the information you provide, including your identity, income, rental history and the names of people who will live in the apartment. If a material detail is found to be false, we may decline the application or, where a lease has already been signed, take the steps permitted by the lease and by law.
We assess applications on objective criteria relating to income, rental history, references and the rules of the building. We apply fair housing principles and do not discriminate on the basis of a protected characteristic. Where a screening provider supplies a report, you are entitled to the disclosures required by the Fair Credit Reporting Act, including the name of the provider and the right to dispute inaccurate information.
Submitting an application does not reserve an apartment. A unit is reserved only when a lease has been signed by all parties and the deposit required by the lease has been received. If another applicant signs first, we will tell you promptly and return any application fee that has not yet been earned, in line with the terms disclosed at the time of application.
Where a guarantor is required, the guarantor must sign the guaranty document and provide the information requested. A verbal confirmation from a guarantor is not sufficient to complete an application.
6. Rent, Deposits and Fees
Rent, the deposit and any other charge are stated in the lease. We do not add charges that are not disclosed in the lease or required by law. Where a fee applies, such as a late payment charge permitted by the lease, we will explain it plainly and apply it consistently.
Payment must be made by the method stated in the lease. If a payment is returned or reversed by a bank, the lease may provide for a returned payment charge and for the payment to be made again by a cleared method. We will not ask you to send card details by email, and you should never send a password, a full card number or a bank credential in a message.
A deposit is held in accordance with California law and the terms of the lease. At the end of the tenancy we provide an itemized statement of any deductions and return the balance within the period required by statute. If you disagree with a deduction, you may contact the desk and we will review the condition reports and receipts with you.
Rent may change at renewal in accordance with the lease and applicable law. A renewal offer states the new rent and the date it takes effect, and you will have a reasonable opportunity to consider it before the term ends.
7. Tenancy Obligations
A tenant must pay rent on time, keep the apartment in reasonable condition, comply with the lease and the building rules, and avoid unreasonable disturbance to neighbors. The apartment must be used as a private residence unless the lease permits a home business, and any such permission is subject to the building rules and applicable law.
A tenant must not sublet the apartment or add an occupant without the written agreement required by the lease. Requests to add an occupant are reviewed with the same care as an initial application, including identity and occupancy limits. A short term rental arrangement is not permitted unless the lease and the building rules expressly allow it.
Pets are permitted only where the lease and the building rules allow them. A pet agreement may require an additional deposit and confirmation of vaccination and licensing where applicable. A service animal or an assistance animal is handled as a reasonable accommodation and is not subject to a pet fee.
A tenant is responsible for the conduct of guests and visitors. Damage caused by a guest is treated in the same way as damage caused by the tenant. Repeated disturbances may lead to enforcement action under the lease after a warning, except where the lease permits immediate action for a serious safety issue.
8. Move-In and Move-Out
Move-in and move-out times are arranged with the desk. A coordinator confirms the elevator booking, the loading area and any protection required for corridors and door frames. A tenant must follow the booking and must not obstruct a fire route, a neighbor entrance or an accessible path.
At move-in, the tenant receives a condition report and is invited to note any pre-existing damage within the period stated in the lease. Photographs taken during the walkthrough are attached to the report. This record is used at move-out to distinguish fair wear from damage.
At move-out, the apartment must be returned in the condition required by the lease, allowing for reasonable wear and tear. Keys, fobs and parking permits must be returned at the agreed time. A move-out inspection is arranged with the tenant, and the findings are recorded in writing. Where a tenant cannot attend, the inspection may proceed with a representative or in the manner permitted by law.
Utility accounts should be transferred or closed in line with the instructions given at move-out. The desk will provide a reminder list, but the transfer itself remains the responsibility of the tenant.
9. Maintenance and Access
Tenants must report faults promptly. A request can be made by telephone, by email to hello@rdfutahliving.buzz or through the contact page. Urgent faults, such as a water leak, a failed heating system or a loss of power in the apartment, should be reported by telephone so that the on-call process can begin at once.
The desk opens a numbered ticket for each request, assigns a tradesperson and confirms an access window. A tenant must provide reasonable access for a repair, an inspection or an emergency response. Access will be arranged with notice, except in an emergency where immediate entry is necessary to prevent damage or danger.
A tenant should not attempt a repair that requires a licensed tradesperson or that involves a shared system. Where a fault is caused by misuse or neglect, the lease may allow the cost of the repair to be charged to the tenant after written notice and a reasonable opportunity to respond.
Contractors are expected to behave professionally, to respect quiet hours and to leave the work area clean. If a contractor does not meet these expectations, the tenant should tell the desk and the matter will be reviewed with the provider.
10. Renewals and Ending a Tenancy
The desk contacts tenants before the lease end date with a renewal offer. The offer states the proposed rent, the term and any change to the terms. A tenant who wishes to renew should respond by the date stated in the offer so that the paperwork can be completed in good time.
A tenant who does not wish to renew must give the notice required by the lease. Notice should be given in writing and acknowledged by the desk. Oral notice may not be sufficient where the lease requires writing, and the safest course is to confirm any conversation by email.
Where a tenant remains in the apartment after the lease ends without a renewal and without the agreement of the landlord, the lease and applicable law determine the terms that apply. The desk will contact the tenant to discuss the position and to avoid an accidental holdover.
The desk handles the end of a tenancy with the same care as the beginning. A move-out inspection, a closing statement and a deposit return are completed within the periods set by law. A tenant who has questions about the process can request a meeting with the desk while the apartment is still occupied.
11. Resident Perks Program
The resident perks program is an optional benefit included in the tenancy. It provides access to preferred arrangements with local partners, such as movers, cleaners and small repair services, and to selected neighborhood offers. Membership carries no fee and creates no obligation to use a partner.
Partners are independent businesses. A service provided by a partner is governed by the agreement between the resident and the partner, including the price, the scope of work and any warranty. We select partners with care and review them periodically, but we do not provide the service ourselves and we are not responsible for the acts of an independent partner.
A partner may be removed from the program at any time if the desk concludes that its standards have slipped. An offer may be withdrawn when it expires or when the partner changes its terms. Residents will be told of a material change on the event board or by email.
The perks program does not affect a tenant rights under the lease. A dispute about a partner service does not suspend the obligation to pay rent or to comply with the lease.
12. Community Event Boards
Residents may propose events for the community boards. A proposal should be sent to the desk with a date, a time, a location, an expected number of guests and the name of the person who will be responsible for the event. The desk reviews each proposal for accuracy, safety and compliance with the building rules.
The desk may decline a proposal or ask for changes where an event would exceed a capacity limit, obstruct a fire route, create a nuisance, promote a commercial product without permission or identify a resident without that resident consent. The decision of the desk is final for the purposes of the board, but it does not restrict a resident from raising a concern through the building management process.
An organizer is responsible for the conduct of an event, for cleaning the space afterwards and for any damage caused. Where an event uses a shared room, the organizer must follow the booking conditions and leave the room in the condition in which it was found.
Cards are removed after the event date. A resident may ask for a card to be removed earlier, and the desk will do so promptly if the request is reasonable.
13. Electronic Communications
By providing an email address or telephone number, you agree that the desk may contact you about an enquiry, an application, a tenancy, a repair, a renewal or a community event. We may use email, telephone or a message sent through the contact form. We do not use automated marketing calls or text campaigns.
You are responsible for keeping your contact details current. A notice sent to the last email address or postal address you provided is treated as delivered in accordance with the lease and applicable law. If your details change during a tenancy, tell the desk promptly.
Email is not a secure channel for sensitive documents. Please do not send a full social security number, a complete card number or a bank password by email. If a document is required, the desk will offer an alternative method such as a secure upload or an in-person appointment.
14. Prohibited Conduct
You must not misuse the website or the desk. The following conduct is prohibited.
Submitting false or misleading information in an enquiry or an application.
Impersonating another person or using another person contact details without permission.
Attempting to access a system, an account or a record that is not yours.
Using automated tools to scrape the site or to send bulk messages to the desk.
Uploading malicious code or interfering with the availability of the site.
Harassing staff, contractors or residents, whether in person, by telephone or online.
Using the event boards to advertise a product or service without the written agreement of the desk.
Recording a conversation with a member of staff without the notice required by law.
Where a serious breach occurs, we may refuse further service, restrict access to the website or take the steps permitted by a lease. We may also report conduct to law enforcement where the law requires or permits it.
15. Third Party Services
The website and the desk may refer you to third parties, including utility companies, insurers, moving companies, cleaners, locksmiths and payment providers. These organizations are independent. Their terms and privacy notices apply to the service they provide.
We choose referrals with care, but we do not control the price, availability or quality of an independent service. If a partner service does not meet expectations, please tell the desk so that the matter can be reviewed and, where appropriate, the partner removed from the perks program.
A link to a third party site is provided for convenience. It does not mean that we endorse the content of that site or that we are responsible for its practices. You should read the terms and privacy notice of any third party before providing information or making a payment.
16. Intellectual Property
The text, layout, graphics and design of this website are owned by RDF UTAH CONDOS LLC or used with permission. The company name, the brand and the visual identity of the site may not be used in a way that suggests a connection with us without written permission.
You may not reproduce, distribute or adapt a substantial part of the site for a commercial purpose. Short quotations with a clear reference to the source are permitted for commentary or review. A request for permission should be sent to hello@rdfutahliving.buzz.
Any material you send to the desk, such as a photograph of a repair or an event poster, remains yours. By sending it, you grant the desk permission to use it for the purpose for which it was sent, for example to assign a repair or to post an event card. We will not publish a resident photograph on a public channel without written permission.
17. Privacy
Our Privacy Policy explains how we collect, use, retain and protect personal information. It forms part of these terms. By using the website or the desk, you acknowledge that you have read the privacy policy.
Where these terms and the privacy policy appear to conflict on a matter of personal information, the privacy policy controls. A privacy request should be sent to hello@rdfutahliving.buzz and will be handled under the process described in the privacy policy.
18. Disclaimers
The website is provided on an as available basis. While we work to keep the information accurate and the site available, we do not warrant that every page will be free of error, that a listing will remain current for any particular period or that access will be uninterrupted.
Nothing on the website constitutes legal, financial or tax advice. A prospective resident should obtain independent advice where a matter is important to them, such as the effect of a lease on a visa, a tax position or a business arrangement.
These disclaimers do not exclude a warranty or a right that cannot be excluded under applicable law, including the statutory rights of a tenant under California law. Where a disclaimer is limited by law, it applies only to the extent permitted.
19. Limitation of Liability
To the extent permitted by law, RDF UTAH CONDOS LLC is not liable for an indirect, incidental or consequential loss arising from the use of the website, such as a loss of profit, a loss of opportunity or a loss of data. This limitation does not apply to a loss that results from our fraud, our wilful misconduct or a matter for which the law does not permit a limitation.
Nothing in these terms limits the obligations of a landlord under a lease or under California housing law, including the duty to maintain a habitable apartment. Where a tenant has a statutory remedy, these terms do not reduce it.
If a court finds that a part of these terms is unenforceable, the remaining parts continue to apply. The unenforceable part will be read down to the minimum extent necessary to make it enforceable, or removed if it cannot be read down.
20. Indemnity
To the extent permitted by law, you agree to indemnify RDF UTAH CONDOS LLC against a claim, loss or reasonable cost that arises from your misuse of the website, your breach of these terms or your infringement of the rights of another person. This obligation does not apply to a loss caused by our own negligence or misconduct.
A tenant obligation under the lease is governed by the lease and is not replaced by this section. Where a claim relates to a tenancy, the lease controls and this section applies only to the extent that it is consistent with the lease and the law.
We will tell you promptly about a claim that may involve this section and will give you a reasonable opportunity to respond. You may not settle a claim in a way that admits fault on our behalf without our written agreement.
21. Disputes and Governing Law
These terms are governed by the laws of the State of California and the applicable laws of the United States, without regard to conflict of law rules. A dispute about a tenancy is also subject to the lease and to the procedures that apply to residential tenancies in California.
If a concern arises, please contact the desk first. Most issues can be resolved through a conversation, a review of the file or a small correction to a record. We will acknowledge a written complaint and aim to respond within ten working days, with an explanation of what we have found and what we propose to do.
Where a matter cannot be resolved directly, the parties may use mediation or another process agreed in writing. Nothing in this section prevents a party from seeking urgent relief from a court or from exercising a statutory right. A tenant may also contact a local housing authority or a legal aid service for independent advice.
22. Changes to These Terms
We may update these terms to reflect a change in the website, a service or the law. The effective date at the top of the page shows when the current version took effect. A material change will be announced on the website and, where appropriate, communicated to residents by email.
A change does not alter the terms of an existing lease unless the lease or the law permits it and the change is agreed in writing. If you do not agree with a change to these terms, you may stop using the website, but an existing tenancy continues under the lease.
We keep previous versions of these terms and can provide a copy on request. If a change is complex, we will explain the reason for it and the practical effect.
23. Contact Information
Questions about these terms should be sent to the resident services desk.
